Service Agreement
This is a Contract between You and PeopleWithHearts.com. We will refer to ourselves in this contract as "PeopleWithHearts.com", "we", or "our." You are an individual person, will be referred as "you", or "your".
This contract covers your use of our service, and includes any other related services, software, support, content, database, and other media. We refer to all of these as the "Service".
This contract limits our liability and we do not provide warranties for the Service. The contract also limits your remedies.
Registration and Use of Services
Registration for membership is required for you to be able to use our Service.
We provide the Service for your personal use. You may not use the Service in a way that is against the law. You may not share or transfer any rights to use the Service to anybody. You may not use it in a way that harms us, our other members, or members of the public. We may tell you about inappropriate uses in a code of conduct or other notices available through the Service. However, we have no duty to do so. You will obey any codes of conduct or other notices we provide. You may start using the Service right after you activate your account.
Use of Services Conduct
Member posting of illegal, vulgar, offensive, indecent, adult rated, advertisements, promotion, solicitations, commercial, politics, violence materials or any materials related to discrimination of race, religion, country of origin, are prohibited on our site at all time. Violation will cause member to be suspended immediately. We reserve the right to amend, request for amendment, censor, cancel or reject to provide any Service to anyone.
Account Responsibility
You are responsible for all activity under your membership account. You may not authorize another person to use your membership account, and you are responsible for keeping confidential any password for your membership account. You must tell us right away about anyone using your account without your consent, or any security breach that relates to the Service.
Materials You Post or Provide.
The use of Service or by providing feedback may allow you to submit materials for public viewing. We are not responsible to the content and do not claim ownership of the materials you post. However, by posting or providing your material, you are granting to the public permission to use, copy, distribute, display, and modify your submission, and to publish your name or alias in connection with your submission. You also give the public permission to grant this permission to other persons. We reserve the right to remove your posted material without your consent and without any obligation to you.
No Warranty on Service
We provide the Service "as-is," and "with all faults". PeopleWithHearts.com gives no warranties, guarantees or conditions. To the extent permitted by law, we exclude the implied warranties.
Liability Limitation
PeopleWithHearts.com liability is limited only to direct damages up to the amount of the particular failed Service. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.
This limitation applies to any matter related to the Service, any matter related to content, viruses or other disruptive agents that affect your access to the use of the Service, any incompatibility between Service and other services, software and hardware, claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence, or other reasons to the extent permitted by applicable law.
Changes to and Cancellation of the Service
We may change the Service or delete features at any time and for any reason. We may cancel or suspend our Service at any time. Our cancellation or suspension may be without cause and/or without notice. Upon cancellation, your right to use the Service stops right away. Once the Service is cancelled or suspended, any data you have stored on the Service may not be retrieved.
Withdrawal of membership
You may cancel your membership at PeopleWithHearts.com at any time, with or without cause, upon notice to us through email. The cancellation can only be initiated by an email of which the address is registered through us. Any prior Services made and materials provided before the termination of membership will continue to have the granting use permission as before the termination of membership.
Choice of Law and Location for Resolving Disputes.
Any legal dispute will be executed in the district court of Pleasanton, California, USA.
